1. Service description

Murmur ("the Service") is an AI-assisted Discord bot that summarizes channel activity and related content on request of authorized users in a Discord server. The Service is proprietary software operated by its maintainer; access is provided through the Service itself, not via source distribution.

2. Eligibility and account

You must have the legal capacity to enter into this agreement and must comply with Discord's own Terms of Service. By adding the Service to a Discord server, the server administrator ("Operator") represents they have the authority to do so on behalf of that server.

The Service includes automated content-safety checks. Requests that are flagged may be refused, logged, or rate-limited. Persistent abuse may result in server- or user-level blocks, as described in the Privacy Policy.

4. Paid plans and billing

The Service offers a free tier and optional paid tiers. Paid-tier payments are processed by Stripe; the maintainer does not see or store full card numbers. By subscribing, you agree to Stripe's own terms.

Subscriptions renew automatically for the period selected at checkout and may be canceled at any time from the billing portal. Cancellation takes effect at the end of the current billing period. Paid usage is subject to the quotas described in the bot's /billing and /usage commands.

Refunds are issued at the maintainer's discretion. Contact the maintainer (see Section 10) within 14 days of a disputed charge.

5. Bring-your-own-key (BYOK)

Operators may provide their own LLM provider API key via the /setup byok set command. BYOK keys are encrypted at rest and used only to satisfy requests from the server that configured them. The maintainer is not responsible for charges incurred on the Operator's own provider account.

6. Intellectual property

Content that the Service summarizes remains the property of the parties who originally posted it. The Service does not claim ownership of user-generated content. Outputs produced by the Service's LLM are furnished to the requesting user; you are responsible for confirming that your use of those outputs complies with applicable law and platform rules.

7. Availability and changes

The Service is provided on an "as available" basis. The maintainer may modify, suspend, or discontinue the Service, or any feature of it, at any time. Material changes to these Terms will be reflected in the "Last updated" date above; continued use after a change constitutes acceptance of the revised Terms.

8. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. LLM-generated summaries may be inaccurate, incomplete, or misleading and must not be relied upon for consequential decisions without independent verification.

9. Limitation of liability

To the maximum extent permitted by law, the maintainer is not liable for any indirect, incidental, special, consequential, or exemplary damages arising from your use of the Service. The maintainer's aggregate liability for any claim relating to the Service is limited to the amount you paid for the Service in the 12 months preceding the claim.

10. Contact and governing law

Questions about these Terms can be raised in the Murmur support Discord server.

These Terms are governed by the laws of the Republic of Poland. Any dispute arising from them shall be resolved by the Polish common courts competent for the maintainer's place of residence, without prejudice to the mandatory consumer-protection rights of users resident in the EU/EEA.
